THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.10780 OF 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

2. The present Criminal Petition came to be filed under Section 438 of the Code of Criminal Procedure, 1973, by the petitioner/accused seeking release in the event of his arrest in Crime No.23 of 2016 of S.V. University Campus Police Station, Tirupati, registered for the offence punishable under Section 409 IPC.

3. The case of the prosecution is that the informant is doing business under the name and style of Siddhartha Tiles and Sanitary Private Limited, Tirupati. The petitioner, who being the Manager of the said firm, was entrusted to collect the amount from the dealers and customers, misappropriated an amount of Rs.28,00,000/- and utilised the same for his personal benefit. Basing on these allegations, the present crime came to be registered.

4. Learned counsel for the petitioner submits that the health condition of the petitioner is not good and the doctors suspected blood clot in the brain, resulting in diversion of blood supply to all internal organs.

5. Learned Additional Public Prosecutor opposed the same contending that when the Constable went to the house of the petitioner, it was locked and no information was furnished by the

neighbours with regard to the health condition of the petitioner.

6. Having regard to the facts and circumstances of the case, the petitioner shall surrender before the concerned Court and move an application for bail. If the said Court satisfied on health grounds and also on merits, shall consider the same, in accordance with law, on the same day.
