THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36759 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a direction to respondent Nos.2 to 5 to provide police aid for implementing the order of injunction granted in favour of the petitioner on 13.10.2016 in I.A.No.572 of 2016 in S.O.P.No.328 of 2016 by the XII Additional Chief Judge, City Civil Court, Secunderabad.

Case of the petitioner is that he obtained an order of injunction on 13.10.2016 in I.A.No.572 of 2016 in S.O.P.No.328 of 2016 on the file of the XII Additional Chief Judge, City Civil Court, Secunderabad and for implementation of the said order, police protection is necessary; that he has already made a representation, dated 18.10.2016, to respondent No.2 seeking police protection and the same has not been considered and hence, he prays to give a direction to respondent Nos.2 to 5 to provide police protection for implementation of the said order.

Heard and perused the material available on record. 4.

Considering all the facts and circumstances of the case, it is left open to respondent Nos.1 to 5, particularly, respondent No.2, to consider the representation, dated 18.10.2016, of the petitioner and if they are of the view that there is necessity to provide police protection to the petitioner for execution of the interim order, dated 13.10.2016, in I.A.No.572 of 2016 in S.O.P.No.328 of 2016 on the

file of the XII Additional Chief Judge, City Civil Court, Secunderabad, they are at liberty to provide police protection. 5.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
