THE HON'BLE SRI JUSTI CE A.V.SESHA SAI C.M.A.No.102 of 2014 ORDER:
On reference to the Lok Adalat, the Lok Adalat passed the following Award dated 13.8.2016.
"The dispute between the parties having been referred for determination to the Lok Adalat and the parties having compromised the case case/matter, the following Award is passed in terms of the settlement.
1. Sri Akshay Kulkarni, Legal Officer, ICICI Lambard General Insurance Company Limited and Sri.V.Atchuta Ram, learned counsel for respondent/applicant and both the parties are present. The matter has been settled amicably between the parties.
2. It is stated by both the parties that they have settled amicably and in pursuance of the compromise between them, the applicant agreed to receive a total sum of Rs. 2,81,115/- as against the awarded amount of Rs.3,12,350/- in full quittance of his claim against insurance Company.
3. It is stated by the insurance Company that it has already deposited the entire amount as per the award.
4. Accordingly, the award is passed for the above said amount of Rs.2,81,115/- (Rupees two lakhs eighty one thousand one hundred and fifteen only) in favour of the applicant in full quittance of his claim against insurance Company and the applicant shall be entitled to receive the same together with interest, if any, accrued thereon from out of the deposited amount. The Insurance Company shall be entitled to refund of Rs.31,235/- along with accrued interest thereon, if any.
5. The parties are informed that the court fee, if any, paid by any of them before lower court shall be refunded.
In view of the above, there shall be a Decree in accordance with the said Award. Accordingly, the CMA stands disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date: 21.9.2016 DA
