This petition is filed by the petitioner to withdraw H.M.O.P.No.19 of 2013 from the file of Senior Civil Judge's Court, Pithapuram, East Godavari District and transfer the same to the Family Court, Vijayawada, Krishna District.

When the matter is taken-up for hearing, learned counsel for the respondent states that the OP sought to be transferred is already decreed and the cause in the transfer petition does not survive. Learned counsel for the petitioner states that they have filed petition for setting aside the exparte decree in the said OP. As on today, the OP is not restored. As such, transfer CMP is liable to be dismissed.

Accordingly, the Transfer CMP is dismissed with liberty to the petitioner to file fresh Transfer CMP, if OP is restored. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
