Heard Sri E.V.V.S.Ravi Kumar for petitioner, Ms. Saleha Begum holding for Sri S. Lakshminarayana Reddy for 2nd respondent and the Assistant Government Pleader for Respondents 1, 3 to 6.

2. The petitioner prays for the following relief: " ....writ of mandamus declaring the action of the respondents in trying to dispossess the petitioner and his family members from the land of an extent of Ac.26.10 cents in Old Sy.No.180, which correlates to New S.No.174 of Kapuluppada Village in Bheemunipatnam Mandal, Visakhapatnam District and for the Dry land of Ac.1.15 cents situated in S.No.142/ 2 of Madhurawada Village of Visakhapatnam Ruraal Mandal, without following due process of law, pending consideration of the representation before the Settlement Officer cum Joint Collector and Assistant Director, Survey and Land Records, as illegal, arbitrary and contrary to law."

3. Mr. Ravi Kumar, after taking note of the case at which the right is enforced by filing a writ petition, does not press the writ prayer and seeks liberty to workout all prayers, in accordance with law, before the competent authorities. The statement is placed on record.

4. The writ petition is dismissed accordingly. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
