THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.3806 of 2018 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Home (AP).

The action on the part of the respondents, in opening rowdy sheet against the petitioner herein is under challenge in the present Writ Petition.

According to the learned counsel for the petitioner the action of the respondents, in opening rowdy sheet against the petitioner, is highly illegal and arbitrary and is opposed to the very spirit and object of the Police Standing Orders. It is submitted by the learned counsel that, as on today no criminal cases are pending against the petitioner herein and the petitioner herein is an agriculturist.

On the other hand, it is submitted by the learned Government Pleader that the petitioner herein can make an appropriate application before the Deputy Superintendent of Police-6th respondent herein, who is the competent authority for considering the issue.

Recording the above submission, the Writ Petition stands disposed of, keeping it open for the petitioner to make an application before the sixth respondent-Deputy Superintendent of Police (SDPO), Eluru, for redressal of his grievance, within a period of two weeks from the date of receipt of a copy of this order and, if any such application is made, the same be

considered and appropriate action be taken, strictly in accordance with law, within a period of three months from the date of filing of the application.

As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. __________________ A.V.SESHA SAI,J 07th February, 2018 Tsy
