HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.30748 OF 2017 ORDER:

This Writ Petition is filed to declare the action of respondents in not considering the claim of the petitioner for appointment as Junior Assistant on compassionate grounds, as illegal and arbitrary.

2. The case of the petitioner is that her mother, N. Prabhavathi, who was working as Junior Sanitary Worker, Community Health Centre, Peddapalli, retired from service on Medical Invalidation on 29.10.2015 and made a representation to the authorities for considering the case of the petitioner for appointment as Junior Assistant on compassionate grounds, after submitting relevant documents. Respondent No.4, vide proceedings in Rc.No.E5/87/ Supdt.Pdpl/2017, dated 01.07.2017, addressed a letter to respondent No.3 for taking further action. Pursuant to the same, respondent No.3 vide proceedings No.A2/1671/2017, dated 27.07.2017, addressed a letter to respondent No.4 stating that as per G.O.Ms.No.92, G.A. (SPF-MD) Department, dated 27.03.2016, it is the competent authority and shall take further action on the appointment of the petitioner. As no action is being taken yet, the present Writ Petition is filed.

3. Heard both sides.

4. Since, respondent No.3 already addressed a letter, dated 27.07.2017, to respondent No.4 stating that it is the competent authority to take further action on the appointment of petitioner, it is for respondent No.4 to take appropriate action.

5. Hence, respondent No.4 is directed to take appropriate action in pursuance of the proceedings, dated 27.07.2017, within a period of eight (8) weeks from the date of receipt of a copy of this order.

6. With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. __________________________ A. RAJASHEKER REDDY, J September 12, 2017 MD
