THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CIVIL REVISION PETITIN No.5643 of 2015 ORDER:

This revision is preferred by the defendants in the suit O.S.No.390 of 2006. They moved I.A.No.154 of 2015 under Order VII Rule 11 (d) of Civil Procedure Code for rejection of the plaint. In a suit, which is pending ever since 2006, the present application is moved nearly after 9 years for rejection of the plaint. As it is a suit standing at the stage of subjecting P.W.1 for crossexamination, the Court below dismissed the said application filed by the defendants.

I do not find any error of jurisdiction committed by the Court below in dismissing the present application. Hence, I decline to entertain the present revision. Accordingly, the revision is dismissed. No costs.

However, the Court below is directed to ensure that the said suit is of the year 2006, shall be decided as expeditiously as possible, preferably within a maximum period of three (3) months from the date of receipt of a copy of this order.
