THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1417 of 2015 ORDER:

This Criminal Revision Case is filed by the petitionercomplainant aggrieved by the order dated 26.05.2014 passed in Crl.M.P.No.1429 of 2014 in C.C. No.495 of 2003 on the file of IX Special Magistrate, Erramanzil, Hyderabad whereby the learned Magistrate allowed the application filed by the accused-second respondent herein filed under Section 311 Cr.P.C. to recall P.W.1 for further cross-examination.

The main contention raised by the learned counsel for the petitioner is that P.W.1 was extensively cross-examined by the counsel for the second respondent in parts on several occasions and his cross-examination was ultimately completed on 20.3.2014 and when the matter was adjourned for examination of the accused under Section 313 Cr.P.C., the impugned application is filed only with an intent to protract the proceedings.

Heard and perused the material available on record. Considering the facts and circumstances of the case and the nature of proceedings, the second respondent herein is directed to confine his cross-examination of P.W.1 only to the extent of account number, its particulars and also to the extent whether it stands in the name of the accused or in the name of any other persons and whether the second respondent-accused is the authorized signatory of the said account.

With the above direction, the revision is disposed of. Miscellaneous petitions pending, if any, shall stand closed.
