This Criminal Petition, under Section 407 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ de facto complainant, to transfer C.C.No.432 of 2013 on the file of the Judicial Magistrate of First Class, Vikarabad to Miyapur XIX Metropolitan Magistrate Court, Rangareddy or to any other Court in Hyderabad having jurisdiction.

Heard the learned counsel for the petitioner/ de facto complainant, the learned Additional Public Prosecutor representing respondent No.6/ State and perused the record. 3.
In the course of submissions, it is brought to the notice of this Court that the Court of Sessions was pleased to dismiss the transfer criminal petition filed by the petitioner. 4.
This petition is filed on the ground that the petitioner/ de facto complainant has got a small baby and is residing at Hyderbad, which is 70 kms away from Vikarabad. As seen from the record, most of the witnesses hail from Vikarabad. The petitioner is only a prosecutrix. She need not go to the trial Court on every date of hearing. The Assistant Public Prosecutor will take care of her case on all dates. Under these circumstances, the petition is lacking merits.

Hence, the Criminal Petition is dismissed.
