HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 1264 of 2017 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With consent of both the parties, the main writ petition is being taken up for disposal at the admission stage itself.

2) The present writ petition came to be filed with the following prayer:

" ..issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the fourth respondent in taking action on the directions of the third respondent in L.Dis.G/ 7845/ 2017, dated 07.11.2016 for include the deleted Sy.Nos.90/ 4, 81/ 8, 6/ 1 and 80/ 10 of the petitioner in E Pass Book situated at K.G.Sathram, Chekurupalli Village NO.177, Gunda Kattamanchi Village Accounts of Bangarupalyam Mandal, Chittoor District, as illegal, arbitrary, contrary to law; and violative of principles of natural justice; and direct the fourth respondent to include the above said survey numbers in the petitioner's E Pass Book forthwith."

3) A perusal of the material on record would show that pursuant to a letter dated 07.11.2016 the Revenue Divisional Officer, Chittoor (third respondent) directed the Tahsildar (respondent No.4) to take note of the contents of the petition filed by the petitioner and take action in accordance with the provisions of law. The inaction of the Tahsildar is subject matter

of dispute in the present writ petition. If the said letter is still in force, the fourth respondent shall act upon the petition filed by the petitioner and pass orders in accordance with law, at an earliest, after hearing the petitioner and aggrieved persons, if any.

4) With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
