THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.30909 of 2011 ORDER:

This Writ Petition was filed aggrieved by the action of the police authorities in continuing a rowdy sheet in the name of the petitioner on the file of Mangalghat Police Station, Hyderabad. Relying on the written instructions dated 09.07.2015 received from the Sub-Inspector of Police, Mangalghat Police Station, Hyderabad, the learned Assistant Government Pleader for Home informed this Court that the petitioner was involved in 8 criminal cases and therefore, the Assistant Commissioner of Police, Goshamahal, Hyderabad, accorded permission to open a rowdy sheet in his name as per the Andhra Pradesh Police Manual Standing Order 602(1). The said rowdy sheet was stated to have been extended up to 31.12.2015.

However, the Sub-Inspector of Police conceded that the petitioner was acquitted in 6 out of the 8 criminal cases lodged against him and was bound over for good behaviour in the 8th offence. The 7th offence is under the provisions of the Andhra Pradesh Gaming Act, 1974, and it is stated that the case is pending trial. However, whether the involvement in an offence under the said Act would be serious enough to warrant continuance of a rowdy sheet in the name of the petitioner is open to question. Learned Assistant Government Pleader for Home, upon obtaining instructions, informed this Court that the acquittal of the petitioner in the 6 cases was on merits and he was not let off only on benefit of doubt.

In that view of the matter, it is for the authority concerned to apply its mind and decide as to whether continuance of the rowdy sheet in the name of the petitioner on the file of Mangalghat Police Station, Hyderabad is still warranted.

The Writ Petition is therefore disposed of leaving it open to the petitioner to make a suitable representation to the Assistant Commissioner of Police, Goshamahal, Hyderabad with necessary documentation in respect of his claim that the rowdy sheet opened in his name need not be continued. In the event, such an application is made, the Assistant Commissioner of Police, Goshamahal, Hyderabad shall consider the same in accordance with law and take appropriate action in the matter.

Pending miscellaneous petitions shall also stand dismissed in the light of the afore-stated final order. No order as to costs. ____________________ SANJAY KUMAR, J 29th JULY, 2015.
