HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.15820 of 2002 ORDER:

When the matter is taken up for hearing, counsel for the petitioner as well as learned Government Pleader appearing for the respondents submitted that the issue raised in this writ petition is squarely covered by the order passed by this Court in W.P.No.17341 of 2001, dated 26.11.2010, and contended that the present writ petition be allowed in terms of the above said order.

In view of the above submissions and for the reasons alike in the order dated 26.11.2010 in W.P.No.17341 of 2001, this writ petition is allowed and the award dated 08.01.2001 is set aside and the matter is remitted to the Industrial Tribunal-cum-Labour Court, Godavarikhani, for adjudication afresh on the basis of material available on record and in the light of the observations made in W.P.No.17341 of 2001. Considering the fact that the matter has been kept pending for a sufficiently long time, the Labour Court, Godavarikhani is requested to take up this matter on priority basis and dispose of the same expeditiously in any event not later than six months from the date of receipt of a copy of this order. No order as to costs.
