THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.15172 of 2007 ORDER:

This Writ Petition is filed questioning the proceedings dated 13.07.2007 issued by the first respondent superseding the Managing Committee elected on 30.04.2005.

The term of the Office of elected Managing Committee would run upto 2010 whereas the impugned proceedings came to be issued in 2007.

This Court on 17.07.2007, having found a prima facie case that the provisions of the Andhra Pradesh Cooperative Societies Act, 1964 do not empower the Deputy Registrar of Cooperative Societies to set aside an election to a society and that a person-in-charge was appointed without setting aside the election, granted interim suspension as prayed for.

Inasmuch as the very challenge by the petitioners is to the effect that their term of Office extends upto 2010 and the same has been suspended by the impugned proceedings in 2007 and considering the fact that we are in 2015, it can be said that nothing survives in the Writ Petition. Even assuming that the Writ Petition is to be allowed or dismissed, it does not make any difference, as the term of Office had already expired.

Accordingly, the Writ Petition is closed.
