HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19504 OF 2003 O R D E R :

This writ petition is filed declaring the action of the respondents in continuing the disciplinary proceedings pursuant to the charge sheet No.B9/Estt./333/2002-03 even after retirement of the petitioner on attaining the age of superannuation w.e.f 31.03.2003 withholding the superannuation, gratuity and leave encashment and other benefits, as illegal and arbitrary. This Court on 07.11.2003 granted the interim order which reads as follows:

"The respondents had initiated disciplinary proceedings just before the retirement of the petitioner. Now, in view of the pendency of disciplinary proceedings, the petitioner is denied the retrial benefits. Of course, the respondents can do so.

But so far as the amount relating to gratuity is concerned, the respondents are directed to release the same immediately in favour of the petitioner." Learned counsel for the petitioner submits that the in view of the aforesaid interim order passed by this Court, no further orders are required in the writ petition.

Recording the same, the writ petition is disposed of interms of the interim order passed by this Court. No costs. As a sequel, miscellaneous petitions, pending, if any shall stand closed.
