The Hon'ble Sri Justice C.V.Nagarjuna Reddy and The Hon'ble Smt. Justice T.Rajani Family Court Appeal No.268 of 2015 Date: 25.01.2017 Between:

G.Srinivasulu ... Appellant and Madela Venkata Lalitha and 2 others

...Respondents

Counsel for the Appellant:

Mr.Karri Murali Krishna Counsel for the respondents:

Mr.J.Janaki Rami Reddy The Court made the following:

CVNR, J & TR, J FCA.No.268 of 2015 Dt: 25.01.2017 Judgment: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Family Court Appeal (FCA) is filed against interlocutory order, dated 04-08-2015, in IA.No.122 of 2014 in FCOP.No.26 of 2012 on the file of the Judge, Family Court, Kurnool.

Under Section 19 (1) of the Family Courts' Act, 1984, an Appeal shall lie from every judgment or order, not being an interlocutory order, of a Family Court to this Court both on facts and on law.

The learned Counsel for the appellant has not disputed the fact that the order against which the present FCA is preferred is an interlocutory order.

In view of the same, this FCA is not maintainable and the same is, accordingly, dismissed as such without adjudicating on merits. This order, however, does not preclude the appellant from availing any other legal remedies available to him in law.

CVNR, J & TR, J FCA.No.268 of 2015 Dt: 25.01.2017 As a sequel to dismissal of the FCA, FCAMP.No.533 of 2015, filed by the appellant for interim relief, is disposed of as infructuous.

______________________ (C.V.Nagarjuna Reddy, J) ___________ (T.Rajani, J) Dt: 25th January, 2017 Note:

The Registry is directed to return the certified copies of the documents filed by the appellant in this FCA.
