When this Appeal Suit is taken up for hearing, learned counsel for the appellant/defendant stated that the appellant instructed the learned counsel to withdraw the Appeal Suit. He, therefore, sought permission to withdraw the Appeal Suit and prayed for dismissal of the Appeal Suit as withdrawn.

Recording the submissions, the Appeal Suit is dismissed as withdrawn.

There shall be no order as to costs.
