THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.3890 of 2018 ORDER:
Heard the learned counsel for the petitioner and the learned Government Pleader for Social Welfare. The action on the part of the second respondent, in not passing orders on stay petition in appeal, dated 08.01.2018, filed against the order, rejecting the issuance of Konda Dora (ST) caste certificate to the petitioner, is under challenge in the present Writ Petition.
It is submitted by the learned counsel for the petitioner that the Tahsildar, Jiyyammavalasa Mandal, Vizianagaram District-fourth respondent herein, by way of an order, dated 18.12.2017, rejected the request of the petitioner herein for issuance of caste certificate. As against the said order, the petitioner herein filed an appeal before the District Collector, Vizianagaram-second respondent herein on 20.01.2018, but no orders have been passed so far. It is further submitted that the impugned action is coming in the way of prosecuting studies by the petitioner herein and his future prospects. Having regard to the submissions made by the learned counsel for the petitioner and the learned Government Pleader, this Court deems it appropriate to dispose of the Writ Petition, with a direction to the second respondent to take appropriate action by passing orders on the appeal, dated 08.01.2018, as expeditiously as possible, strictly in accordance with law.
Accordingly, the Writ Petition is disposed of.
Miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
