THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.30241 of 2017 ORDER:

This writ petition is filed for a writ of Mandamus declaring the order of the fourth respondent dated 24.08.2017 in Rc.No.BS/95/2017, suspending the license of the petitioner to carry on the business, by exercising powers under Section 31(1)(b) of the A.P. Excise Act, 1968, as arbitrary and illegal and for a consequential direction to set aside the same.

Learned counsel for the petitioner submits that in similar circumstances, this Court disposed of W.P.No.25003 of 2017, dated 27.07.2017, and the same is not disputed by the learned Assistant Government Pleader for Prohibition and Excise (Telangana). In view of the same, this writ petition is disposed of in terms of the order dated 27.07.2017, passed by this Court in W.P.No.25003 of 2017, directing the petitioner to submit explanation to the show cause notice within a period of one week from today and thereafter, it is open for the respondents to take further action and pass final orders after affording opportunity to the petitioner. Till passing of final orders, the impugned order shall stand suspended. Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
