THE HON'BLE DR.JUSTICE SHAMEEM AKTHER TRANSFER CRIMINAL PETITION NO.31 OF 2018 ORDER:

This petition is filed by the petitioners under Section 407 Cr.P.C. to transfer DVC No.3 of 2017 on the file of III Addl. Judl. Magistrate of I Class, Ongole to the Court of Senior Civil Judge, Kavali.

Heard learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioners would submit that there is a life threat to the petitioners, who are the respondents in the above DVC.

The day-to-day presence of the petitioners is not required in DVC. This Court has observed the same in many cases. Under these circumstances, the presence of the petitioners is dispensed with in DVC No.3 of 2017, pending on the file of III Addl. Judl. Magistrate of I Class, Ongole. When there is specific purpose for their appearance, the Court below may order so.

With the dispensation of the personal appearance of the petitioners, the Transfer Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Petition shall stand closed.
