THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8049 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to modify the order, dated 30.05.2016, passed in Crl.M.P.No.269 of 2016 in Criminal Appeal No.455 of 2016 on the file of the III Additional District and Sessions Judge, Ranga Reddy District, at L.B.Nagar, insofar as the condition to deposit one-fifth of the fine amount i.e., Rs.1,02,000/- before the trial Court.

Heard and perused the records.

Learned counsel for the petitioner submits that the petitioner is not in a position to comply with the order of the Court below and as such, prays this Court to modify the order dated 30.05.2016 in Crl.M.P.No.269 of 2016 in Criminal Appeal No.455 of 2016.

Considering the facts and circumstances of the case, this Court is not inclined to interfere with the order of the Court below as the criminal petition itself is not maintainable and the petitioner is directed to approach the appropriate forum by invoking appropriate provisions. The criminal petition fails and is liable to be dismissed. The Registry is directed to return the original documents filed along with the criminal petition.

The Criminal Petition is accordingly dismissed.
