The petitioner was appointed as Fair Price Shop dealer of Krishnapuram Village, Darsi Mandal, Prakasam District. While so, on 06.02.2015, the Enforcement Deputy Tahsildar, Darsi, along with Food Inspector, Podili and Mandal Revenue Inspector, Darsi, inspected the fair price shop of the petitioner and noticed certain irregularities. They submitted a report, based on which proceedings under Section 6-A of the Essential Commodities Act ("the Act" for brevity) were initiated and they are pending before the second respondent. It appears that the petitioner submitted a detailed representation on 08.02.2015 to the second respondent alleging that during the inspection, proper facts were not recording by the inspecting officials. In the circumstances, the petitioner filed the present Writ Petition. Learned counsel for the petitioner submits that inspection is not completed by the second respondent and his representation dated 08.02.2015 with regard to the facts recorded at the time of the alleged inspection were not taken into consideration by the second respondent so far.
In the circumstances, the second respondent is directed to consider the petitioner's representation dated 08.02.2015 and take necessary action in that regard while conducting enquiry in respect of proceedings under Section 6-A of the Act pending before him. It is needless to mention that the second respondent shall conduct proper enquiry in respect of proceedings under Section 6-A of the Act pending before him and pass final orders thereon, as early as possible, not later
than two (2) months from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed. ________________________ (A.RAMALINGESWARA RAO, J) 10th August 2015 RRB
