THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 15064 OF 2017 O R D E R :

This Writ Petition has been filed questioning the inaction on the part of the 4th respondent Prohibition & Excise Superintendent, Tirupati in revoking the order dated 12.04.2017, whereby the A4 shop licence held by the petitioner was suspended, even after compounding the alleged offence by collecting the fee of Rs.1,00,000/-.

It is not necessary for this Court to narrate the facts for which the suspension has been ordered, particularly considering the fact that the petitioner had made an Application seeking to compound the offence, in terms of the Andhra Pradesh Excise (Compounding of Offences) Rules, 1973.

The case of the petitioner is that the alleged offence is the first one, that too by the nowkarnama and it is ready and willing to get the offence compounded by paying the necessary fees. Learned counsel for the petitioner submits that in similar circumstances, the respondents have, in fact, revoked the licence and permitted the similarly-situated persons to run their business. Heard learned Government Pleader for Prohibition & Excise. In those circumstances, the Writ Petition is disposed of directing the 4th respondent to pass necessary orders on the Application of the petitioner, within one week from the date of receipt of a copy of this order. No costs.

Consequently, the miscellaneous Applications, if any shall stand disposed of.
