HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.4579 OF 2019 O R D E R:

The prayer of the petitioners in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue writ or direction more particularly one in the nature of writ of mandamus declaring action of the respondents in not disposing of my appeal and not directing the 3rd respondent to register and release the sale deed executed by Challa Satya Rekha in favour of petitioners in respect Plot No 206 admeasuring 500 Sq Yards or 418 Sq Mts in Sy No 5/3 of Raidurg Panmaktha Village situated at B N Reddy Hills Serilingampally Mandal Ranga Reddy District in terms of the judgment passed by this Hon'ble court in WP No.

47984/2018 dated 03 01 2019 as being illegal arbitrary discriminatory and violative of article14 of the constitution of India and to pass such other relief or reliefs as this Hon'ble court deems fit and proper in the circumstances of the case." Perusal of the record reflects that aggrieved by the refusal order dated 07.06.2018 of the Joint Registrar-I, Registration Office (OB), Ranga Reddy District, the petitioners filed an appeal before the District Registrar, Ranga Reddy District, on 18.06.2018. The endorsement made thereon bears out that the office of the District Registrar received it on the very same day. Having received such an appeal, it is not open to the statutory appellate authority to keep the same pending indefinitely.

Further, as rightly pointed out by Sri Praveen Kumar Challa, learned counsel for the petitioners, the issue raised in the said appeal stands squarely covered by the decision of this Court in W.P.No.47984 of 2018.

The Writ Petition is accordingly disposed of directing the District Registrar, Ranga Reddy District, to consider the petitioners' appeal on its own merits and keeping in mind the decision of this Court in W.P.No.47984 of 2018 and pass appropriate orders expeditiously and in any event, not later than three weeks from the date of receipt of a copy of this order. Pending Miscellaneous Petitions, if any, shall stand closed. No order as to costs.
