THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.204 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.172 of 2013 on the file of the Judicial First Class Magistrate, Razonel, East Godavari District, arising out of offences under Sections 498-A, 494, 384, 506 read with Section 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act. Heard and perused the material available on record. Learned counsel for the petitioner confines his argument with regard to dispensing with the presence of the petitioner before the Court below and also recall of the Non Bailable Warrants (NBWs) issued against the petitioner. He submits that the absence of the petitioner herein before the Court below is neither wilful nor wanton. Hence, the learned counsel prays this Court to recall the Non Bailable Warrants (NBWs) issued against the petitioner.

The petitioner is directed to appear before the Court below and file an application for recalling NBWs issued against her on or before 10.05.2016, and on filing of such application, the Court below is directed to recall the NBWs issued against the petitioner on the same day on condition of her executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum to the satisfaction of the said Magistrate. Further, the presence of the petitioner before the Court below is dispensed with except on the dates when the Court below insists for her presence. The petitioner is directed to represent her case through the counsel on all hearing dates.

The Criminal Petition is accordingly disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 12.04.2016 pln
