HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.36005 of 2015 ORDER :

Petitioner is presently working as Software Engineer in the officer of Centre for Railway Information Systems, Railway Reservation Complex, South Central Railway Secunderabad. For the years 2011-12, 2012-13 and 2014-15, the Reporting Officer has assigned appropriate grades and the annual confidential records are favourable to the petitioner. However, the Reviewing Officer having found that the grades granted by the Reporting Officer are not correctly made,

reduced the grades and also made certain comments. Aggrieved by the said orders, petitioner preferred appeals before the appellate authority i.e, Registrar and the said appeals are rejected by the 2nd respondent without considering the petitioner's contentions. Challenging the same, petitioner preferred an appeal on 10.10.2015 before the 2nd respondent and the same has not been disposed of. Aggrieved by the inaction of the 2nd respondent in not disposing of the petitioner's appeal, the petitioner filed the present writ petition.

2. Counsel for the petitioner contends that the petitioner is eligible for Senior Software Engineer and at this stage, on account of the adverse grade given by the Reviewing Officer, his right for consideration for promotion is severely effected.

When the matter is taken up for hearing, the learned Standing Counsel for respondents on instructions submits that though on verification of the official records, the appeal filed by the petitioner is not traced, but since a copy of the said appeal is filed in the material papers filed in this writ petition, the appellate authority will consider the same and take decision as warranted by law.

4. Having regard to the above submissions, this Writ Petition is disposed of directing the 2nd respondent to consider the appeal filed by the petitioner on 10.10.2015 and pass appropriate orders in accordance with law by duly taking note of the grounds urged by the petitioner in the appeal, as expeditiously as possible, preferably within a period of four (04) weeks from today, at any rate before considering any further promotion to the cadre of Senior Software Engineer. There shall be no order as to costs.

5. As a sequel, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
