HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO S.A.M.P.No.1381 of 2016 IN/AND SECOND APPEAL No.969 of 2016 COMMON ORDER :

S.A.M.P.No1381 of 2016 is filed to record the compromise and allow the second appeal in terms of compromise. Pursuant to the direction of this Court dated 28.09.2016, the District Legal Services Authority, Vijayawada, recorded compromise between the appellants/defendants and and the 1st respondent/plaintiff. The 2nd respondent/3rd defendant shows died. In fact, the 2nd respondent alienated the property in favour of the appellants and the 1st respondent herein filed a suit that the 2nd respondent has no title to alienate and the appellants cannot acquire any title. It is practically the lis between the appellants and the 1st respondent herein and since compromise, the 2nd respondent died and appeal even abated without bringing the legal representatives it will not come in the way, recorded to consider.

Accordingly, the compromise recorded is upheld and the second appeal is disposed of in terms of the compromise. Miscellaneous petitions pending, if any, shall stand dismissed. No costs.
