HONOURABLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.17158 of 2013 ORDER:

This writ petition is filed to declare the action of the respondent Nos. 1 and 2 in allowing the respondent No.5 to proceed with the construction without any sanctioned plan and without following the norms set out by the Fire Department, in respect of the building bearing Municipal No.21-11036/63/67/E/1 to 26 adjacent to Masjid-e-Mirde Munnawar Pathergatti, as illegal and arbitrary.

When the matter came up for admission on 18.6.2013, an interim order was granted directing to maintain status quo with regard to construction undertaken by respondent No.5. The writ petition is disposed of giving liberty to the petitioners to submit a fresh representation to the first respondent, within two weeks from the date of receipt of a copy of this order and the first respondent is directed to pass appropriate orders thereon within a period of eight weeks thereafter after giving opportunity of hearing to the petitioner and the unofficial respondent. Till the representation is disposed of, the respondent No.1 is directed to maintain status quo with regard to the construction undertaken by respondent No.5, which was already granted by this Court on 18.6.2013.

The writ petition is disposed of. No order as to costs.
