THE HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL REVISION CASE No.47 of 2017 ORDER:

Heard both sides and perused the impugned order dated 26.12.2016 passed in Crl.M.P.No.313 of 2016 in Crl.A.No.131 of 2016 by the learned V Additional Sessions Judge, Kothagudem.

2) The order in directing to deposit the entire arrears of maintenance awarded in D.V.C. No.8 of 2010 on or before 05.01.2017 and to continue to deposit Rs.3,000/- per month until disposal of the appeal and giving liberty to withdraw 50% out of it is modified to one of deposit of 50% of the arrears and to continue to pay maintenance @ Rs.3,000/- per month and with permission to withdraw the said 50% of the arrears of the amount without prejudice to contest in the main appeal for any adjustment therefrom whatever paid and payable pursuant to this order.

3) Accordingly, the revision is allowed in part permitting the petitioner to pay all the arrears within six weeks from today, failing which to enforce execution. 4) Miscellaneous petitions, if any, shall also stand closed.
