The grievance of the petitioner is that, at the instance of the 5th respondent, the 3rd respondent - Inspector of Police, Cherial and the 4th respondent - Station House Officer, Komaravelli Police Station have been interfering with his possession and enjoyment over the land in an extent of Acs.11.00 in Survey Nos. 144/B1 and 144/A2 of Guravannapet Village, Komaravelli Mandal, Siddipet District.
The case of the petitioner is that on 19.08.2017, when he was about to start the work in the subject land by using JCB, the 4th respondent seized the same and released the same after 24 hours. It is also the case of the petitioner that he acquired Acs.11-00 of land through a Will executed by his father and the 5th respondent has no manner of right.
Heard learned counsel for the petitioner.
Learned Government Pleader for Home (Telangana) submits that as a matter of fact, on a complaint made by the 5th respondent against the petitioner, a case in Crime No. 23 of 2017 was registered on 19.08.2017 for the offences punishable under Sections 447 and 427 read with Section 149 of the Indian Penal Code.
Considered the respective submissions. As is evident from the very affidavit filed by the petitioner and narration of facts in relation to the property, it appears there were some property disputes between the petitioner on the one hand and the 5th respondent on the other. In those circumstances, the petitioner
shall work out the other remedies available to him in law to protect his interests rather than involving the police machinery. The Writ Petition is therefore, closed. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
