HON'BLE MR JUSTICE R. KANTHA RAO Writ Petition No.30960 OF 2015 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking a writ of mandamus declaring the action of the respondents 2 and 3 in not considering the case of the petitioner for appointment to the post of Village Revenue Officer duly extending the proceedings No.A4/5455/2013, dated 07.02.2015 issued by the second respondent as illegal, arbitrary, unreasonable and violative of Articles 14 and 16 of the Constitution of India and consequently direct the respondents to consider the case of the petitioner for appointment to the post of Village Revenue Officer in any one of the existing vacancies taking into consideration, the proceedings No.A4/5455/2013, dated 07.02.2015 issued by the second respondent.

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. The petitioner claims to have worked as Nominee of the Village Administrative Officer under Rule 25 of A.P. Village Administrative Officer Service Rules, 1990. He submits that he passed Intermediate in the year 1981. The petitioner's father worked as Village Administrative Officer and after his death, the petitioner discharged the duties of V.A.O. for certain period as per the authorisation of the revenue authorities. He submitted the representation to the then Collector requesting him to appoint him as Village Revenue Officer in his father's place as per G.O.Ms.No.39(VA) Department, dated 11.01.2008. According to the petitioner, as per the aforesaid G.O.

he is entitled to be appointed as Village Revenue Officer as he possess the requisite qualification for the said post. He further submits that by working as assistant to the Village Administrative Officer for a considerable time, he acquired the knowledge in all revenue laws and he is capable of performing the duties of Village Revenue Officer.

Learned Government Pleader for Revenue appearing for the respondents

submits that on the application submitted by the petitioner, the Tahsildar is making an enquiry and appropriate action will be taken after the Tahsildar submits his report.

Under the aforesaid circumstances, the writ petition is disposed of directing the respondents to consider the case of the petitioner for appointment as Village Revenue Officer subject to his eligibility and in accordance with rules within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
