HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.4669 of 2020 ORDER :

This writ petition is filed seeking Mandamus to declare the action of respondent No.3 in not paying compensation to the petitioner in respect of the subject lands and issuing proceedings dt.13.02.2020, as arbitrary and illegal, and consequently sought a direction to respondent No.5 to pay compensation in respect of the subject lands to the petitioner. Heard learned counsel for the petitioner and the learned Government Pleader for Revenue.

Since there is a dispute with regard to payment of compensation in respect of the subject lands and when the petitioner is seeking a direction for non-payment of compensation in respect of the subject lands to one Mr. Mohd. Yousuf and others and pay the same to her, though learned counsel for the petitioner contends that they are not necessary parties to the writ petition, without arraying the said effected persons as party respondents to the writ petition, the writ petition cannot be entertained. Accordingly, this writ petition is dismissed for nonjoinder of proper and necessary parties. No order as to costs.

ARR,J W.P.No.4669 of 2020 As a sequel, miscellaneous applications pending, if any, shall stand closed.
