HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4589 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus to declare the inaction of respondent Nos.2 to 4 in conducting the survey over the petitioner's land ad measuring Ac.0.10 guntas Sy.No.32/2 situated at Chandi Village, Shivampet Mandal, Medak District, in spite of specific representation and paying requisite fees through F-Line petition dated 13.12.

2018 is illegal, arbitrary, in violation of principles of natural justice and in violation of Articles 14, 21 and 300A of the Constitution of India besides in violation of the Survey and Boundaries Act and also in violation of the Circulars issued by the Government and consequently direct the Respondents to conduct the survey and demarcate the petitioner's land and fix the boundaries thereon by considering the petitioner's FLine petition dated 13.12.2018 and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Perusal of the record reflects that the petitioner submitted a F-line petition on 13.12.2018 seeking a survey of the subject land and fixing of boundaries thereon. Having received such an application, it is not open to the revenue authorities to remain somnolent.

The Writ Petition is accordingly disposed of directing the respondents to take appropriate action upon the petitioner's F-line petition dated 13.12.2018 for conducting a survey of the subject land and fixing of boundaries thereon. This exercise shall be completed expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order, be it from whatever source.
