This petition is filed under Section 24 of C.P.C. seeking to withdraw O.P.No.1528 of 2014 from the file of the Family Court, Visakhapatnam, and transfer the same to the file of the Family Court, Secunderabad, to try along with I.A.No.1082 of 2015 in O.P.No.540 of 2012.

Heard the learned counsel for both parties.

At the time of arguments, learned counsel for the respondent submitted that the Family Court, Secunderabad, dismissed I.A.No.1082 of 2015 in O.P.No.540 of 2012 on 26.09.2017. In view of the dismissal of I.A.No.1082 of 2015, there are no grounds to allow the petition.

Hence, the Transfer Civil Miscellaneous Petition is closed. However, closing of this petition does not preclude the petitioner to file similar type of petition at appropriate stage. There shall be no order as to costs.
