The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri P Rajeswara Rao, Advocate for the Petitioner, and of Additional Public Prosecutor for the respondent, the Court made the following.

ORDER

THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.1506 of 2020 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioner/accused, seeking to grant anticipatory bail to him in Crime No.66 o'f 2020 on the file of Chaitanyapuri Police Station, Rachakonda District, registered for the offences under Sections 353 and 504 lPC.

Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor representing the respondent-State and perused the record.

lt is alleged in the complaint that on 04.02.2020 at about 1900 hours, when the de-facto complainant being Sub-lnspector of Police, Traffic, along with his staff was clearing the traffic at service road from Dilsukhnagar to LB Nagar road, with traffic recovery van, one Royal bullet bike bearing No.TS'-02-EX-5322, was stopped between the service road, and they picked up the bike on the recovery van, in the meantime, the accused came there, abused them in filthy language and obstructed to his duty by creating nuisance. 4.

Learned counsel for the petitioner/accused submits that the police filed a false case against the petitioner in order to harass him and that there is no material on record to show that he committed the alleged offence. He further submits that the petitioner/accused is not the owner of bike and he is no way concerned with the alleged !

bike. He further submits that the entire investigation is completed, except filing of charge sheet. He also submits that the petitioner is a permanent resident of Chaitanyapuri, Hyderabad, having movable t .-*.-.--

\ and immovable properties and he IS ready to furnish sufficient sureties to the satisfaction of the Court and he shall abide by any condition imposed by this Court.

Learned Additional Public Prosecutor opposed to grant anticipatory bail to the petitioner/accused.

In view of the nature of allegations leveled against the petitioner/accused and other facts and circumstances, without adverting to the merits of the matter, lam inclined to grant anticipatory bail to him, by imposing some conditions 7.

Accordingly, the Criminal Petition is allowed and the petitioner/accused is directed to surrender before the Station House Officer, Chaitnyapuri Police Station, Rachakonda District, within a period of 15 days from the date of this order. On such surrender, the said Station House Officer sllall release the petitioner/accused on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum each to his satisfaction. Further, the petitioner/accused shall abide by the conditions stipulated in Section 438(2) Cr.P.C and co-operate with the investigating officer in investigating the case. 8.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
