ORDER
This Criminal Petition is filed seeking to enlarge the petitioner, on bail, who is arrayed as accused No.3 in Crime No.166 of 2025, on the file of CCS Police Station, Hydearabad, registered for the offences punishable under Sections 316 (2), 318 (4) read with 61(2) BNS and Section 5 of TSPDFEA Act. 2.
The prosecution case in brief is that on 15.12.2025, the de-facto complainant lodged a complaint against the accused stating that accused No.1 induced him and his family
members to invest money in trading business. Believing the representations, the complainant and his family members transferred amounts over a period of time though bank transactions and cash. Initially, some profits were paid, but later the accused stopped repayments and postponed returns on one or other pretext and the amounts were misappropriated instead of being used for the stated business purposes, as such a case is registered against accused. 3.
Heard Sri B. Bhagath Sain, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent.

Learned counsel for the petitioner submitted that the petitioner is arrayed as accused No.3 and she is no way connected with the alleged offences. In fact, the complainant and his family members were invested money with accused No.1 and the petitioner never induced them to invest money. He further submitted that the material part of investigation is completed and the petitioner has been in jail since 31.12.2025. Therefore, he prayed this Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that offences alleged against the petitioner are grievous in nature, she involved in the huge financial crimes and all the accused are family members. He further submits that accused Nos.1 and 3 are traced out, the other accused are in absconding. If the petitioner is released on bail, there is a chance of tampering evidence, as such, granting bail to the petitioner, at this stage, does not arise. Hence, he prayed the Court to dismiss the criminal petition. 6.
In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it appears that the amounts which were collected by accused No.1 were diverted to accused No.3 and there is no agreement between the de-facto complainant and the petitioner. As seen from the record, the petitioner is in jail since 31.12.2025. Considering the facts and submissions of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner, subject to the following conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned XII Additional Chief Judicial Magistrate at Nampally, Hyderabad.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
