Heard.
As parties are going to settle the matter amicably and stated cheque amount already paid outside the Court through settlement as per the admission of the complainant - respondent No.1 to the revision against the conviction judgment of the trial Magistrate for the offence under Section 138 of Negotiable Instruments Act (for short, 'the Act') by the lower appellate Court invoking Section 147 of the Act and from the expression of the Apex Court, the parties are permitted to compound subject to payment of costs of Rs.12,000/- to the Army Welfare Fund by the petitioner/accused/appellant. Proof of payment of costs filed vide memo dated 27.03.2019. Accordingly, the Revision is allowed and I.A.No.2 of 2019 is allowed by compounding the offence punishable under Section 138 of Act. Hence, the conviction judgment of the trial Court which was confirmed by the lower appellate Court is hereby set aside. Full satisfaction recorded. Accused is acquitted. Bail bonds of the accused, if any, shall stand cancelled.
