.....RESPONDENTS Counsel for the Petitioner: SRI MANGENA SREE RAMA RAO Counsel for the Respondent Nos.1 and 2: AGP FOR PANCHAYAT RAJ (AP) The Court made the following :
ORDER:
This writ petition is filed for a mandamus to declare the inaction of respondent No.3 in preventing respondent No.4 from raising further construction without obtaining permission over his property, as illegal and arbitrary.
On the petitioner's own showing, he has filed O.S.No.12 of 2015 on the file of the Principal Junior Civil Judge, Alamuru, against respondent No.4 with the same grievance as expressed in this writ petition. In my opinion, having availed an appropriate legal remedy, the petitioner cannot pursue parallel remedies. The petitioner is therefore permitted to avail further rleiefs as may be necessary to prevent respondent No.4 from proceeding with the construction in the pending civil suit.
Subject to the liberty given to the petitioner as above, the Writ Petition is dismissed.
As a sequel to disposal of the writ petition, W.P.M.P.No.52261 of 2015 filed by the petitioner for interim relief is disposed of as infructuous. ____________________________ C.V.NAGARJUNA REDDY, J Date: 14.12.2015 va
