Subhash Reddy) This Civil Miscellaneous Appeal is filed by the appellant - defendant in O.S. No.1027 of 2012 on the file of II Additional District Judge, Ranga Reddy District at L.B. Nagar (for short 'trial Court'), aggrieved of the order and decree, dated 25-09-2012, in I.A. No.3301 of 2012 in O.S. No.
1027 of 2012. 2. The aforesaid suit is filed by the respondent - plaintiff for specific performance of agreement of sale, dated 12-122005. The case of the respondent - plaintiff is that the appellant - defendant entered into an agreement of sale with him on 12-12-2005 for sale of land, ad measuring Acs.1-30 guntas in Survey No.29/3, situated at Jeedimetla village, Qutbullahpur Mandal, Ranga Reddy District for a total sale consideration of Rs.60,00,000/- (Rupees sixty lakhs only). The appellant received Rs.30,00,000/-(Rupees thirty lakhs only) towards advance from the respondent herein on the date of agreement of sale and also received the balance sale consideration of Rs.30,00,000/- (Rupees thirty lakhs only) on 11-01-2006.
But, the appellant, having received the entire sale consideration amount, failed to execute registered sale deed in favour of the respondent. Hence, the respondent filed O.S. No.1027 of 2012 against the appellant seeking specific performance of the agreement of sale. Along with the said suit, the respondent - plaintiff filed I.A.3301 of 2012 seeking grant of temporary injunction, restraining the appellant herein, his men, supporters etc. from transferring the suit schedule property by any manner during the pendency of suit. 3. On the other hand, it is the case of the appellant - defendant that he had taken some amount from the respondent - plaintiff towards loan and gave blank signed stamped papers and, subsequently, the respondent - plaintiff fabricated such papers into agreement of sale.
It is also stated that there was no agreement of sale at all for sale of the suit schedule property and as the suit is based on the fabricated document i.e., agreement of sale, dated 12-12-2005, the same is to be liable to be dismissed. 4. The trial Court, having considered the contents of the affidavit, the counter affidavit and the documentary evidence on record, allowed I.A. No.3301 of 2012, by orders, dated 25-09-2013, granting temporary injunction restraining the appellant, his men and supporters from alienating or transferring the suit schedule property in favour of third parties during the pendency of suit. 5. Aggrieved by the order, dated 25-09-2013, in I.A. No.3301 of 2012 in O.S. No.1027 of 2012, passed by the trial Court, the plaintiff preferred the instant appeal. 6. Heard Sri P.
Shiv Kumar, learned counsel for the appellant and Sri Gaddam Srinivas, learned counsel for the respondent. 7. Even in this appeal, it is contended by the learned counsel for the appellant that the appellant has not agreed, at any point of time, to sell the suit schedule property and that the agreement of sale, dated 12-12-2005 and the subsequent receipt, dated 1101-2006 are fabricated documents by which the respondent made the alleged claim. 8. On the other hand, it is submitted by the learned counsel for the respondent - plaintiff that the agreement of sale is executed by the appellant herein, in the presence of two witnesses, having received the advance amount of Rs.30,00,000/-. It is further submitted that the balance amount of Rs.
30,00,000/- was also received by the appellant on 11-01-2006 and receipt was issued and, in spite of the same, the appellant herein failed to execute registered sale deed in favour of the respondent - plaintiff. It is further submitted that, as the appellant herein was negotiating with third parties to sell the suit schedule property, the respondent filed the suit for specific performance of the agreement of sale and also filed I.A. No.3301 of 2012 seeking temporary injunction and, the trial Court having considered the documentary evidence on record, granted temporary injunction, and there are no merits in the appeal to interfere with the order of the trial Court. 9. The copies of agreement of sale, dated 12-12-2005 and subsequent receipt, dated 11-01-2006 are also placed on record and we have perused the same.
In this case, it is to be noticed that the appellant herein is not disputing the signature on the alleged agreement of sale, dated 12-12-2005, but it is his case that when he obtained loan from the respondent, he has given blank signed stamped papers, which were converted into agreement of sale, and basing on the same, a false claim is made. 10. On perusal of record, it is clear that the trial Court granted temporary injunction on 25-09-2013. In this appeal, this Court has not granted interim orders suspending the operation of the said injunction order and, thus, the temporary injunction is in operation for more than one and a half year. It is also brought to our notice that the main suit is at the stage of leading evidence on behalf of the plaintiff.
Since it is the case of appellant that the agreement of sale and the subsequent receipt are fabricated, though the signatures are admitted, it is a matter, where definite findings are to be recorded by the trial Court, for which a full- fledged trial is required by adducing evidence on both sides. Further, in the absence of granting any interim orders by this court suspending the temporary injunction in this appeal for the last more than one and a half year and having regard to the findings recorded by the trial Court, we are of the view, that there are no grounds to interfere with the order of the trial Court at this stage and, thus, the appeal is devoid of merits. 11.
Inasmuch as it is brought to our notice that the suit is of 2012 and is coming up for leading evidence on behalf of the plaintiff, we deem it appropriate to direct the trial Court to dispose of the main suit itself, as expeditiously as possible, preferably within a period of eight (08) months from today. Further, it is needless to observe that the suit may be disposed of on merits, uninfluenced by the observations, if any, made by this Court. 12. The Civil Miscellaneous Appeal is disposed of with the aforesaid direction. No order as to costs. 13.
