THE HON'BLE SRI JUSTI CE SANJAY KUMAR CONTEMPT CASE No.862 of 2016 ORDER:
This contempt case was instituted alleging willful disobedience to the order dated 07.04.2016 passed in W.P.No.11566 of 2016. By the said order, the Greater Hyderabad Municipal Corporation (GHMC) was directed to consider the representations dated 15.03.2016 and 30.03.2016 made by the petitioner with regard to the alleged unauthorised construction made by the fifth respondent in the writ petition and take action thereon, if warranted, in accordance with the due procedure. The authority concerned was directed to afford an opportunity of hearing to all the parties who would be affected by the decision taken upon the said representations. This exercise was directed to be completed within a time frame. Alleging that steps were not taken as directed, the present contempt case was filed.
The Deputy Commissioner, Circle-3B, GHMC, L.B.Nagar, Ranga Reddy District, filed a counter-affidavit. Therein, he stated that the fifth respondent in the writ petition, who allegedly made unauthorised constructions, submitted an application under the Building Penalisation Scheme on 26.01.2016 to regularise her unauthorised construction. This application was made under the umbrella of a Government Order, which was subjected to challenge in PIL No.361 of 2015 before the High Court. The GHMC is stated to have prepared speaking order dated 16.06.2016 and sent the same to the petitioner informing him that further necessary action would be taken based on the final outcome of the regularisation application submitted by the fifth respondent in the writ petition.
In the light of the aforestated development and as the public interest litigation is yet to be disposed of, this contempt case is closed leaving it open to the petitioner to take steps, if warranted, in future by filing a fresh case. No order as to costs.
