THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3944 of 2018 O R D E R:

The grievance of the petitioner is that though he submitted a plan on 21.09.2017 before respondent No.3-Panchayat Secretary, Setturu Village and Mandal, Anantapuramu District for approval, no action has been taken thereon.

Learned Standing Counsel for respondent No.3 submits that if the approval is not granted within 15 days from the date of receipt of the plan, the petitioner can as well avail the benefit of Clause 26 of G.O.Ms.No.67, dated 26.02.2002.

In the light of the above submission, the writ petition is disposed of with the direction to respondent No.3 not to interfere with the construction of the petitioner in any manner as long as the construction is in conformity with the norms. However, constructions permitted to be made shall be subject to the final orders/permission of the Gram Panchayat.

Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:09.02.2018 kdl
