HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.9198 of 2015 ORDER:
This writ petition is filed to declare the action of the respondent authorities in threatening to demolish the houses of the petitioners i.e. Assessment No.1506, D.No.4-150, 4-17, 4-30/1, 4-296, 4-10, 4-79, 4-275, 4-17, 4-155 (New), 4-156 and 4-31 respectively, situated at Pamur village and Mandal, Prakasam District, without issuing any notice and without following the due process of law, as illegal and arbitrary. The case of the petitioners is that they are the absolute owners of the subject houses and a news item was published in Andhra Jyothi Telugu daily newspaper on 17.3.2015 directing them to remove their houses voluntarily as the said land is required for the public purpose; without issuing any notice and without following the procedure contemplated under law, the respondents are trying to demolish their houses. Hence they filed the present writ petition.
An interim direction was granted on 1.4.2015 directing the respondents not to demolish the houses of the petitioners. As the writ petition is filed basing on a news item published in Andhra Jyothi and as the petitioners contend that they are the owners of the subject premises, the respondents are directed to verify the same and
follow the procedure as contemplated under law before demolishing the houses of the petitioners.
With the above direction, the Writ Petition is disposed of. No order as to costs.
