HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CIVIL REVISION PETITION No. 758 of 2018 ORDER:

The present application came to be filed under Article 227 of the Constitution of India assailing the order dated 25.01.2018 in I.A.No. 123 of 2018 in H.M.O.P.No. 147 of 2016, on the file of the Senior Civil Judge, Ramachandrapuram.

It is represented by the learned counsel for the petitioner that earlier, the wife of the petitioner filed H.M.O.P.No. 147 of 2016 seeking divorce, and thereafter, the petitioner filed O.P.No. 349 of 2017 on the file of the III Additional Senior Civil Judge, Kakinada seeking restitution of conjugal rights. The learned counsel further submits that the petitioner is ready for compromise, and that the observations made in the order in the O.P. that the reconciliation proceedings between the parties proved futile, were prior to the filing of the application for restitution of conjugal rights. Hence, seeks that the matter may be referred to Lok Adalat.

Having regard to the above, the Senior Civil Judge, Ramachandrapuram shall enquire with both the parties as to whether they are willing for a compromise and then proceed further in accordance with law.
