THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.14370 OF 2008 O R D E R :

When the matter is taken up for hearing, none appears for the petitioner inspite of the fact that the matter is listed under the caption 'for dismissal'.

This writ petition is filed alleging that the respondents are trying to demolish the existing structures in the schedule property of the petitioner.

Learned Standing counsel appearing for the respondents had contended that the writ petition itself is not maintainable as it is filed on mere apprehension. He further contends that the respondents would follow due process of law in the event of initiating action against the petitioner.

This Court, having considered the rival submissions of both the parties, is of the considered view that this writ petition can be disposed of directing the respondents to follow due process of law before initiating any action against the petitioner. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
