This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioner, who is A1, on bail in Crime No.60 of 2017 on the file of the Station House Officer, Chinturu Police Station, East Godavari District.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The Public Prosecutor brings to the notice of this court the earlier order, dated 02.01.2018, passed by this court in Crl.P.No.12808 of 2017, wherein this court, by considering the merits of the case, dismissed the bail petition filed by the petitioner herein. It was observed in the said order that earlier the court granted bail to the petitioner on medical grounds and he again indulged in illegal transportation and sale of Ganja. Hence, the medical grounds, which were put forth as a reason for grant of bail, were also not taken into consideration by this court and accordingly the said petition was dismissed. 4.

Hence, in view of the above, this court opines that this is not a fit case for granting bail to the petitioner. With the above observations, the Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
