THE HON'BLE SRI JUSTI CE V. RAMASUBRAMANI AN AND THE HON'BLE SRI JUSTI CE A. SHANKAR NARAYANA CONTEMPT CASE No.1438 of 2016 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) This contempt case arises out of an order dated 07.12.2015 passed in a writ petition challenging an auction notice under the SARFAESI Act, 2002.
2. Heard Mr. T. Vijay Kumar, learned counsel for the petitioner.
3. In the order dated 07.12.2015, the auction purchaser was directed to maintain status quo. But it is seen from the said order that the auction purchaser was not one of the respondents. There is also no indication in the order that the auction purchaser was represented by the counsel at the time when the order dated 07.12.2015 was passed.
4. Though it is stated by the learned counsel for the petitioner that he had filed a petition for impleading and a petition for direction in W.P.M.P.Nos.45987 & 38908 of 2015, the fate of those petitions is not known. In any case, the auction purchaser was not a party to the order dated 07.12.2015. Therefore, leaving it open to the petitioner to work out his remedies in the writ petition and seek appropriate reliefs against the bank and the auction purchaser, this Contempt Case is closed.
5. As a sequel, miscellaneous petitions pending in this contempt case, if any, shall stand closed.
