THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.5620 of 2015 ORDER :

Heard learned counsel for petitioner and Sri R.Radha Krishna Reddy, learned Standing counsel for the Respondent No. 2 & R.3 and with their consent, the writ petition is taken up for disposal at the admission stage.

2. The petitioner claims to be an interested person in the wakf property being a muslim, and intend to protect the wakf property. The petitioner alleges that there were illegal encroachments over an extent of 3731 Square yards, and on constant representations, and persuasions, the Chief Executive Office, A.P.State Wakf Board, Hyderabad-4th respondent conducted enquiry and issued show cause notice under Section 54 of the Wakf Act to the encroachers including the respondents 5 to 8 and passed final orders of Eviction under Section 54 (3) of the Wakf Act and communicated the same to the Revenue Divisional Officer, for implementation of the orders. However, so far no further steps are taken.

Pending implementation of the orders of the 4th respondent, the respondents 5 to 8 are making illegal and unauthorized constructions on the Wakf property. The petitioner raised objections to the unauthorized constructions but the respondents 5 to 8 threatened the petitioner and stated that they would not stop the work. The petitioner has given complaint to the respondent-authorities on 18.02.2015. Alleging no action is taken on the representation of the petitioner and on the other hand the respondents 5 to 8 are going ahead with construction activity, this writ petition is filed.

3. When the matter is taken up, both counsel agreed for disposal of the writ petition with a direction to the respondent authorities to expeditiously dispose of the complaint dated 18.02.2015 submitted by the petitioner.

4. Having regard to the same, without expressing any opinion on the merits of the matter, writ petition is disposed of directing the respondent authorities to consider the complaint of the petitioner dated 18.02.2015 and pass appropriate orders as warranted under law, within a period of six weeks from the date of receipt of copy of this order, after putting on notice the respondents 5 to 8 and after affording due opportunity of hearing and communicate the decision to the petitioner. No costs. Having regard to the
