THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.3849 of 2018 ORDER:

The grievance of the petitioners is that the 7th respondentPanchayat Secretary, who has been made as party-respondent in his personal capacity, in collusion with the 8th respondentSarpanch, who has also been made as a party-respondent in her personal capacity, has abused the power and made various omissions and commissions. The details have been set out by the petitioners in their representation dated 12.01.2018, followed by detailed representations dated 22.01.2018 and 27.01.2018. In spite of the same, respondent authorities have not acted on the same.

Heard the learned counsel for the petitioners, the learned Government Pleader for Panchayat Raj (AP) and the learned Standing Counsel for Gram Panchayat.

Inasmuch as, petitioners grievance is only with respect to the inaction on the part of the respondent authorities and the complaints having been made against the Sarpanch as well as on the Panchayat Secretary, without going to the merits of the matter, the Writ Petition is disposed of with a direction to the 5th respondent-District Panchayat Officer, to examine the allegations made by the petitioners and take appropriate action in accordance with law. There shall be no order as to costs. Consequently, Miscellaneous Petitions pending, if any, in this Writ Petition, shall stand closed.
