HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.30 of 2015 ORDER:

This revision is filed against the order dated 08.01.2015 passed by the Judicial Magistrate of First Class, Suryapet in Crl.M.P.No.43 of 2015 in Cr.No.08 of 2015. The revision petitioner is accused in the above crime registered by P.S. Suryapet for the offences punishable under Sections 379, 420 and 120 (B) of IPC.

The petitioner's vehicle i.e., Lorry bearing No.AP-29-TB-1111 was seized and the said vehicle is sought for return before the learned Judicial Magistrate of First Class, Suryapet by filing Crl.M.P.No.43 of 2015 and the same was ended in dismissal on 08-01-2015. Challenging the same, the present revision is filed.

In fact, the authority entitled to confiscate is provided under Section 28 of A.P.WALTA Act, 2002. Further, G.O.Ms.No.186, dated 1712-2013 enclosed in the revision grounds speaks that, if it is a first violation with certain fine and for a subsequent violation with enhanced amount of fine or penalty as the case may be. Having regard to the above, the revision is disposed of directing the petitioner to approach the authorities concerned (pursuant to the G.O.Ms.No.186 supra) for release of the vehicle subject to payment of penalty provided thereunder.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
