THE HON'BLE SRI JUSTICE SANJAY KUMAR Contempt Case No.1773 of 2014 ORDER:

This contempt case was filed alleging wilful disobedience to the order dated 16.09.2009 passed by this Court in W.P.No.27449 of 2007 as well as the order dated 28.07.2011 passed in C.C.No.1535 of 2010. By the order dated 16.09.2009 passed in W.P.No.27449 of 2007, this Court remanded the matter to the Tahsildar, Venkatagiri Mandal, Nellore District, to conduct a fresh enquiry for the purpose of mutation of the petitioners' names taking into consideration the ryotwari patta granted to them and decide the matter afresh after issuance of notice to all the parties concerned. Contempt Case No.1535 of 2010 was instituted alleging wilful disobedience to the aforestated order. This contempt case was dismissed by order dated 28.07.2011, taking note of the fact that the Tahsildar, Venkatagiri Mandal, had issued proceedings dated 21.07.2011 effecting mutation in the names of the petitioners in the revenue records.

The present contempt case was instituted thereafter, alleging that when the petitioners approached the revenue authorities for issuance of a 'No Objection Certificate' (NOC) their request was denied once again raising the same issue as to the genuineness of their ryotwari patta.

It is now stated by the learned Assistant Government Pleader for Revenue that the Sub-Collector, Gudur, has issued the NOC as sought for by the petitioners. A copy of the said certificate dated 27.08.2015 is produced.

Perusal thereof reflects that the Sub-Collector, Gudur, acting upon the recommendation of the Tahsildar, Venkatagiri Mandal, for issuance of a NOC in favour of the petitioners, certified that there was no objection to sale transactions by the petitioners in respect of the land admeasuring Acs.5.32 cents in Survey No.161/3 of Periyavaram

Village, Venkatagiri Mandal, Nellore District, subject to the outcome of Writ Petition No.31825 of 2014.

In view of the aforestated development, the cause for grievance on the part of the petitioners no longer survives and no disobedience is made out to the orders passed by this Court.
